Half-Truth Harry Breaks Filibuster Deal

There is no need for any Republican to feel bound by the shameful bargain made last Monday to prevent use of the Constitutional Option to break the judicial filibuster. Harry Reid broke it Monday night

In the privacy of his Capitol office last Monday night, Sen. Harry Reid, D-Nev., asked for commitments from six Democrats fresh from the talks. Would they pledge to support filibusters against Brett Kavanaugh and William Haynes, two nominees not specifically covered by the pact with Republicans?

Some of the Democrats agreed. At least one, Sen. Ben Nelson of Nebraska, declined.

Details of Reid's attempt to kill the two nominations within minutes of the agreement, as well as other events during this tumultuous time, were obtained by The Associated Press in interviews with senators and aides in both parties. They spoke on condition of anonymity, citing confidentiality pledges.

The conversation in Reid's office was among the final acts of a drama that played out unpredictably over several weeks. It culminated in a deal that cleared the way for votes on some nominees long blocked by Democrats, left other nominees in limbo and averted a bruising fight over the Senate's filibuster rules.

Now let's look at this. Reid exacted commitments from some of the Democrats who signed on to filibuster certain judges. That goes against the "extraordinary circumstances" pledge, as well as the "own discretion and judgement" provision. That goes against the clear understanding that had been reached.

The deal is therefore dead -- and when Half-Truth Harry got several of the Democrat signatories to break it Monday night.

Several of the Senators have knuckled under to Reid's demand for conformity to the position of the Senate Democrat leadership, and there is nothing extraordinary about any of the two nominees in question -- both are mainstream legal scholars, and both meet with the approval of the ABA, which the Democrats in the Senate once said was the Gold Standard by which a nominee should be judged.

A filibuster of either constitutes a violation of the agreement.

3 If the ABA is such a "gold standard" why the hell was Nancy Grace never disbarred, before she became a shrill talking head on CNN Headline News? The ABA like any other supposed "professional" association is only concerned with protecting their membership, often at the expense of actual justice.
Any one judged "qualified" by the ABA should probably be looked on as suspect, but then again with most americans being too stupid for description, no wonder the approval of the ABA is "gold".

5 As for the issue of the ABA endorsement being the gold standard for judicial nominees, I refer you back to the words of a couple of prominent Democrats back when the Administration was planning on cutting the ABA out of the vetting process. And my source is one you should find acceptable as well -- Rep. Jesse Jackson, Jr., from his own website. You can't get much more Democrat than that. I've been unable to track down the text of the letter in question -- but I doubt you would consider Rep. Jackson a shill for the Bush White House. I've also got an article from leftist periodical you would recognize as legitimate, which while it doesn't contain the "gold standard" quote does indicate that ABA approval means that a judge has met an "acceptably high standard."

I can think of a couple of reasons why the ABA hasn't disbarred Nancy Grace -- the main one being that it is not the ABA's job to do so. Rather, it is the job of the respective state licensing authorities to do so, IF such action is warranted.

As far as Ms. Grace is concerned, I don't know enough about her to know if there is a cause for disbarring her -- I consider her to be a shrill and annoying polemicist whose appearance on my screen is sufficient to make me reach for the remote control.

Second you're correct about the ABA, I guess I wasn't clear enough in wondering why the ABA didn't reccomend Grace for disbarment (which they can do) to the Georgia Bar. This battle over judges is nothing more than a continuation of the right's wish to totally dismantle the social safety-net set up by FDR. Apparently many "centerist" democrats are aboard for the ride as well. You would do well to read more of Molly Ivins/Lou Dubose, and a whole lot less of Limbaugh, O'Rielley, Coulter and Hannity.

7 Well, given that I don't read Limbaugh, O'Reilly, or Hannity, it would be difficult to reduce my intake. As for Coulter, I read her from time to time, but find her shrill and off-putting, even when she is correct.

As for Molly Ivins, I can only read her crap when I am as drunk as she is -- and since my wife and I both gave up drinking after she became ill several years ago (she because of potentially fatal interaction with her medication, me because I want to be supportive), I don't read her semi-coherant ramblings any longer.

And since Dubose appears to be an Ivins clone, I don't think I'll even bother. I've lived this long without ever having heard of him, so i don't think I'm missing much.
